Use of the BrainCell app is at your own risk. To the extent permitted by law, we disclaim all warranties regarding the availability, accuracy, and security of the app.
We are only liable for damages arising from the use or inability to use the app in cases of intent or gross negligence. In cases of slight negligence, we are only liable for the breach of cardinal obligations (essential contractual obligations) and limit this liability to the typically foreseeable damage. Liability for personal injury (life, body, or health) remains unaffected.
These terms apply to all users of the BrainCell app worldwide.
By installing and using the app, you agree to these terms. Minors under 13 may only use the app with the consent of their legal guardians.
Registration is required for certain features. You must provide a valid email address and password. You agree to keep your credentials confidential and to notify us immediately of any unauthorized access.
All copyrights, trademarks, and other intellectual property rights in the app and its content belong to VisionByte GmbH. Reproduction, distribution, or other public use of the content without our express written consent is prohibited.
You may not use the app for illegal or immoral purposes, including the distribution of harmful software, unsolicited mass communication, or other criminal activities. In case of violations, we reserve the right to suspend your account and take legal action.
We may update, modify, or (temporarily) take the app offline at any time. Claims for defects are governed by statutory warranty regulations, unless expressly agreed otherwise.
These provisions supplement the above disclaimer and are an integral part of these terms of use.
The collection, processing, and use of personal data is carried out in accordance with our Privacy Policy, which is part of these terms.
We reserve the right to change these terms with 14 days' notice. Changes are deemed accepted if you do not object in writing within this period.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for all disputes arising from or in connection with these terms is, where permissible, Frankfurt am Main.
VisionByte GmbH is not liable for content posted by users (e.g., decks, stacks, flashcards). For third-party infringements, the liability privilege under §§ 7–10 of the German Telemedia Act applies; liability only begins after knowledge and failure to remove unlawful content.
Each user is responsible for the legality and appropriateness of their own content. Content containing racist, discriminatory, offensive, or otherwise unlawful statements may not be published.
If you become aware of or file a legitimate complaint about unlawful content, you must remove the affected content immediately.
In case of repeated violations of these provisions, we reserve the right to permanently suspend the user account.
The deletion obligation also extends to content that is comparable in substance and statement to previously objected contributions (§ 3 para. 3 NetzDG, § 8 TMG).
